Then you decide you want to stay for good, and the whole thing gets complicated fast. Here's why TN holders hit a wall on green cards, and how EB-5 gets you around it.


The TN Visa's Biggest Blind Spot


Here's the uncomfortable truth about TN status: it has no direct path to a green card built into it. None.


TN was designed under NAFTA, now USMCA, as a temporary professional work visa. You can renew it more or less indefinitely as long as you keep qualifying, but "renew forever" is not the same as "become a permanent resident." The visa was never meant to be a stepping stone to a green card, and it doesn't behave like one.


So you can spend a decade in the U.S. on TN, build a career, put down roots, and still be no closer to permanent residency than the day you arrived.


The Dual-Intent Problem That Trips Up TN Holders


This is where TN gets genuinely risky compared to H-1B or L-1. TN is a strictly nonimmigrant visa with no dual intent. That means you're supposed to demonstrate you intend to leave the U.S. when your status ends.


The problem? The moment you openly pursue a green card through an employer, you can create the appearance of immigrant intent, which can jeopardize your next TN renewal or re-entry. TN holders who start an employment-based green card process sometimes find their border crossings suddenly stressful, or their renewals questioned. It's a real bind: the very act of trying to stay permanently can threaten the status you're currently relying on.


Why EB-5 Sidesteps the Whole Issue


EB-5 is where this gets interesting for TN holders specifically. Because EB-5 is an investment-based path that doesn't run through your employer, it changes the calculus.


You're not asking your company to sponsor you, and you're not tying your green card to your job. Now, TN's lack of dual intent still means you should coordinate timing carefully with an immigration attorney, especially around travel and renewals. But EB-5 gives you a self-directed route to permanent residency that doesn't depend on employer sponsorship or a backlogged category. Your petition stands on its own.

How the TN to EB-5 Path Works


You invest $800,000 in a qualifying rural or TEA project. Your attorney files Form I-526E, which proves the investment is real, the funds are lawful, and the project will create at least 10 jobs. Rural petitions are currently averaging around eight months to approval, with some coming back faster.


Once your petition is approved, you move to a green card through adjustment of status or consular processing, giving you a two-year conditional green card. Two years later, Form I-829 confirms the jobs were created and you get your permanent green card. Five years after that, citizenship is on the table.

Can You File EB-5 While on TN?


You can, but this is the spot where TN professionals need to be more careful than H-1B or L-1 holders. Because TN doesn't allow dual intent, the timing of when you file, when you travel, and when you renew all matters.


Many TN holders work with an attorney to sequence things properly, sometimes filing adjustment of status at a strategic moment, or coordinating around travel so a border officer never has to weigh their immigrant intent.
